About Sean Franklin

Independent Inheritance Law Solicitor serving London and the United Kingdom with over 20 years of dedicated experience

Sean Franklin - Inheritance Law Solicitor

Dedicated Personal Service as Your Independent Solicitor

I practice law as an independent attorney rather than as part of a large law firm. As a sole practitioner, I personally handle my clients' legal matters, including inheritance and estate-related cases, and I oversee each matter directly to ensure dedicated attention and professional representation throughout the entire process. This means you work directly with me, not junior associates or paralegals.

After qualifying as a solicitor in 2003, I developed a specialism in inheritance law, recognising the profound impact that thoughtful estate planning has on families. My approach combines technical legal expertise with genuine compassion for clients navigating often difficult and emotional circumstances. I understand that dealing with inheritance matters often comes at a time of loss or family transition, and I provide the sensitivity and support that clients need during these challenging times.

I am regulated by the Solicitors Regulation Authority (SRA) and maintain full professional indemnity insurance. My commitment is to provide accessible, high-quality legal services without the overheads of a large firm, allowing me to offer competitive fees while maintaining the highest standards of service and personal attention. Every client receives my direct involvement and expertise.

Frequently Asked Questions

Common questions about inheritance law, probate, and our services answered by Sean Franklin

Common Questions Answered

What is the difference between a will and a trust?

A will is a legal document that sets out how you want your assets distributed after your death. It only takes effect upon death and must go through probate. A trust, on the other hand, is a legal arrangement where assets are held by trustees for the benefit of beneficiaries. Trusts can take effect during your lifetime and can provide greater control over how and when assets are distributed, along with potential tax advantages and asset protection benefits.

How much does probate cost in the UK?

The court fee for a grant of probate is £273 for estates valued over £5,000. However, this is just the court fee. Professional fees for administering an estate vary depending on complexity. As a sole practitioner, I offer competitive fixed fees for straightforward estates and transparent hourly rates for more complex matters. Simple estates typically cost £1,500-£3,000 in legal fees. I always provide a clear written estimate before commencing work with no hidden charges.

How long does the probate process take?

The probate process typically takes 6-12 months for straightforward estates, though it can be longer for complex cases. Current processing times at the Probate Registry average 8-12 weeks for obtaining the grant of probate. Factors affecting timing include the estate's complexity, whether there's a valid will, property sales, tax issues, and any disputes among beneficiaries.

What happens if someone dies without a will?

When someone dies without a will (intestate), their estate is distributed according to the rules of intestacy under English law. This may not reflect their wishes. Generally, a spouse or civil partner inherits first, followed by children, parents, siblings, and more distant relatives. Unmarried partners and friends receive nothing. The process also requires letters of administration rather than probate. I strongly recommend making a will to ensure your assets go to your chosen beneficiaries.

Can I write my own will?

While it's legally possible to write your own will, it's not recommended. DIY wills often contain errors that can render them invalid or create unintended consequences. Common mistakes include improper witnessing, ambiguous language, and failure to consider tax implications. As a qualified solicitor, I ensure your will is legally valid, clearly expressed, and tax-efficient. The cost of professional will writing is modest compared to the potential problems of an invalid will.

What is inheritance tax and how can I reduce it?

Inheritance tax (IHT) is charged at 40% on estates above the nil-rate band (£325,000 for 2025/26), with an additional residence nil-rate band (£175,000) available for main homes passed to direct descendants. Strategies to reduce IHT include: making use of annual gift allowances, setting up trusts, leaving gifts to charity, ensuring you maximise all available allowances, and proper estate planning. I can advise on legitimate tax planning strategies tailored to your circumstances.

What is a Lasting Power of Attorney?

A Lasting Power of Attorney (LPA) is a legal document that allows you to appoint one or more people (attorneys) to make decisions on your behalf if you lose mental capacity. There are two types: Property and Financial Affairs LPA (for money and property decisions) and Health and Welfare LPA (for healthcare and personal welfare decisions). LPAs must be registered with the Office of the Public Guardian before they can be used. I recommend having both types in place as part of comprehensive estate planning.

How often should I update my will?

I recommend reviewing your will every 3-5 years or after major life events such as: marriage or civil partnership, divorce or dissolution, birth of children or grandchildren, death of a beneficiary or executor, significant changes in your assets, moving property, or changes in tax law. Even if your circumstances haven't changed, periodic review ensures your will remains valid and reflects current law.
